Planning Commission Minutes 04/12/2012





OLD LYME PLANNING COMMISSION
REGULAR MEETING
THURSDAY, APRIL 12, 2012


PRESENT WERE:  Harold Thompson, Chris Kerr, Steven Ross, and Stephen Martino.  Alternate Todd Machnik was seated for Robert McCarthy.


Chairman Thompson called the meeting to order at 7:00 p.m.


DISCUSSION OF SECTION 5.5.7 AND OTHER PROPOSED REVISIONS TO THE SUBDIVISION REGULATIONS.

The commission reviewed the correspondence from Bonnie Reemsnyder dated March 30, 2012 regarding trash pick up as discussed in the March Meeting minutes.  

Thompson read into the record the paragraph under discussion Section 5.5.7.....

“Covenants to maintain the street in good and safe condition, to make all required repairs, and to undertake snow plowing and refuse collections at no expense to the Town of Old Lyme.  Said covenants shall be expressly enforceable by the town as a third party beneficiary”.

Chris Kerr stated that currently the town does not perform any trash pick up.  He noted it is done by an independent contractor who makes the choice as to where he collects the trash.  Kerr stated he did not feel the wording should be changed.

Ross stated based on the wording you need to take reference out because there is an expense to the town.  

Kerr asked what would happen in the future if the town takes over trash collection would the town then be liable.  

Ross also noted that there is no reference in the wording about recycling pick up.  

Machnik stated currently it is up to the discretion of the refuse operation as to where the pick up happens and if and when Shoreline Sanitation discontinues the service with the town and another company comes in and does not have the kind and gentle attitude the town does not want to make it so we can’t pick it up or we have to pick it up.

Ross stated he felt future situations could be dealt with as they arise.

Discussion ensued.  

Thompson suggested the wording “snow plowing and trash pick up will not be performed by town personnel or by using town equipment”.

Harold Thompson made a motion that the wording be changed to state “that snow plowing, refuse collection and recycling will not be performed by town personnel using town equipment.”  This revised wording will require review and  approval by town counsel.  Steve Ross seconded the motion.  The motion passed unanimously.  5-0-0

RELEASE OF BOND/AS BUILT PLANS

Thompson disturbed proposed language drafted by Attorney Cassella.  Thompson stated he had sent an email to Attorney Cassella and asked him to attend next month’s meeting to discuss the language.  He also stated he would be in contact with Tom Metcalf as to his progress with other proposed changes to the regulations.    

Steve Ross made a motion to table any action on the proposed language until the May meeting.  Stephen Martino seconded the motion.  The motion passed unanimously.

READING AND APPROVAL OF THE MARCH 8, 2012 MEETING MINUTES.

Steve Ross made a motion to waive the reading and approve the minutes as submitted.  Stephen Martino seconded the motion.  The motion passed unanimously.
